In these terms of service, the following words have the meanings set out below.

4. Bookings and Reservations

You are responsible for providing accurate personal and booking information, including the correct number of guests and any applicable ages. If you provide incorrect information that results in additional costs or prevents boarding, we may adjust your booking or offer an alternative accommodation.
We reserve the right to refuse or decline a booking for legitimate operational reasons, including capacity limits, safety concerns, or failure to meet age requirements. Where we decline a booking that has already been paid, we will issue a full refund.
5. Pricing and Payment
All prices shown on the website are in Canadian dollars unless stated otherwise. Prices are subject to change at any time, but the price confirmed at the time of your booking will not change unless there are taxes or regulatory fees introduced after your purchase.
Payment is due at the time of booking for online and telephone reservations unless a different arrangement is agreed in writing. We accept the payment methods described at the time of checkout. Your payment information is processed by a secure third-party payment provider and is not stored by us in readable form.
You agree to pay all charges associated with your booking, including any applicable taxes, service fees, or surcharges. In the event of a payment failure, we may cancel the affected reservation and notify you accordingly.
6. Cancellation and Refunds
We want your plans to be flexible. You may move or cancel a booking at no charge up to twenty-four hours before the scheduled departure, by contacting us at reach@dggniagara.hair or +13347804821.
If you cancel within twenty-four hours of your departure, we will issue a credit that can be applied to a future tour, valid for a period to be confirmed at the time of cancellation. This credit has no cash value and is non-transferable.
For no-show guests who do not arrive for a booked departure and do not notify us, no refund or credit will be issued. Rates and policies for private charters and large groups may differ and will be set out in the specific charter agreement. Where a booking includes a mix of tours, each tour is treated separately for cancellation purposes, and a credit from one cancelled tour cannot be converted to cash but can be applied by the same guest to the cost of another tour within its validity period.
Refunds, where issued, are returned using the same payment method used for the original purchase, unless otherwise agreed. Please allow a reasonable period for your bank or card provider to process the refund.
7. Weather and Operational Conditions
All tours operate subject to river conditions and weather, and our decisions are made with passenger safety as the first and highest priority. We monitor forecasts and water levels closely and may reschedule or cancel departures when conditions give cause for concern.
If we cancel a departure due to weather, river conditions, or other operational reasons, you may rebook to another available departure at no charge, or choose to receive a full refund. You will be given the earliest reasonable notice of any cancellation, and where a cancellation occurs on the day of travel, our crew will communicate with you by the contact details you supplied at the time of booking.
We will not operate a tour when conditions fall below our safety standards, and we make this judgment at our sole discretion. Because river and weather conditions can change quickly, we also reserve the right to shorten a route or alter a programme during a tour for safety reasons, without full refund.
8. Private Charters
Private charters are governed by these terms together with a written charter agreement that sets out the specific date, itinerary, group size, and pricing for your event. In the event of any conflict, the written charter agreement takes priority over these general terms.
A deposit is required at the time a charter is confirmed, with the balance due no later than the date specified in the charter agreement. Cancellation terms for charters are separate from standard tours and are set out in the charter agreement.
The group leader is responsible for communicating our policies to all members of the party and for ensuring that all attendees comply with safety requirements and the code of conduct outlined in the section on guest conduct below.
9. Safety and Guest Conduct
Safety on and around the water is paramount. All guests must follow the instructions of our crew and guides at all times, including during the pre-departure safety briefing, while aboard vessels, and on guided walks.
Guests must wear provided life jackets where instructed and keep arms, legs, and belongings inside the vessel during operation. We may restrict participation where a guest does not meet documented safety, age, or mobility requirements, and we will communicate these requirements before departure where possible.
We expect all guests to behave respectfully toward crew, other guests, and the natural environment. Conduct that is disruptive, threatening, or unsafe may result in the guest being removed from the tour without refund. Guests are also asked to refrain from feeding wildlife, leaving litter, or damaging the gorge environment.
10. Intellectual Property
All content on this website, including text, graphics, logos, images, illustrations, and the overall design, is the property of Dgg Niagara or its licensors and is protected by copyright, trademark, and other intellectual property laws.
The name Dgg Niagara and the associated marks are protected. You may not copy, reproduce, modify, distribute, display, or create derivative works from any content on this website without our prior written permission, except as necessary for your own personal, non-commercial use.

Participation in outdoor and water activities carries inherent risk. By booking and participating, you acknowledge and assume these risks to the extent permitted by law. Nothing in these terms limits our liability for death or personal injury caused by our negligence where such limitation is prohibited by law.
